Our client is seeking an experienced legal professionals to enforce settlement agreements arising from housing disrepair claims. This role is perfect for an experienced civil litigator that wishes to either move into the housing disrepair sector or those that seek “litigation heavy” roles.

About The Role:

Working in our specialist Housing Disrepair Breach of Contract Team, the role will primarily involve post-litigation casework under both Part 7 and Part 8 of the Civil Procedure Rules. You will be responsible for handling your own individual caseload of Claimant matters where the Defendant has breached previously agreed settlement terms, from issue to conclusion.

Purpose of the Role:

The firm operates a very successful housing disrepair team whereby we act for tenants of residential social housing who are complaining of disrepair at their property which their landlord has failed remedy. Cases are pursued under the Housing Conditions Protocol with typical agreements being reached with landlords pre or post litigation in terms of damages, agreed repairs, timescale for completion, and costs.

Unfortunately, a significant proportion of those agreements are subsequently breached by the landlord. Your role will involve enforcement of those agreed terms, particularly relating to any failure to complete agreed repairs at the property in the agreed timescale.

Working within our clients Breach of Contract team, you will typically be responsible for handling a caseload of breach cases post issue, whether that be via Part 8 or Part 7 CPR. The main objective of the role is to seek updated agreement terms with the landlord to include additional damages, repair timescale and costs. This may be achieved through negotiation and/or running cases to trial/final hearing.

Main Duties And Responsibilities:

  • Draft formal/complex Court documents, applications and prepare legal bundles.
  • Ensure the litigation process is carried out in line with statute, best practices, and the firm’s standards.
  • Skilfully negotiate claims/disputes to a successful outcome.
  • Instructing external experts; surveyors and/or Barristers as necessary.
  • Maintaining high levels of client care throughout.

Skills & Competencies:

  • Housing disrepair experience is desirable, but not essential. This position would also suit those from a personal injury background, and for those that wish to move into the growing area of housing disrepair.
  • Ability to handle volume litigation ensuring compliance with key deadlines.
  • Advocacy experience desirable, but not essential.
  • Experience of Proclaim or other case management software is desirable, but not essential.
  • Competent in use of Microsoft packages such as Word, Teams.
  • Excellent communication skills – verbal and written.
  • Ability to make decisions.
  • Effective time-management.
  • Ability to problem solve.
  • Effective negotiator.
  • Commercial awareness.
